Our client’s late husband presented to his local hospital after sustaining a fall and losing consciousness. A CT scan of the head was taken; however, it was reported as not demonstrating any intracranial haemorrhage.
This interpretation was inaccurate and falsely reassuring as the radiologist had failed to identify the presence of a left sided subdural haematoma. It wasn’t until further imaging was taken two days later and then compared to the previous imaging was an acute left subdural haemorrhage identified.
Unfortunately, despite being transferred to another hospital for intensive treatment, our client’s husband passed away. Following the untimely death of her husband, our client developed serious psychiatric injuries.
Seeing the devastating effects of her injuries on her quality of life, our client sought expert advice and assistance from Gerard Malouf and Partners.
Solicitor Susan Newman took on this case and argued on behalf of her client that the treatment provided to her client’s late husband was negligent, and causative of her client’s psychiatric injuries. We obtained expert opinions in support of this argument. On the basis of the expert evidence, we were able to commence proceedings against the local health district.
While some resistance to the claim was initially pressed, we were able to enter into settlement negotiations between the parties by way of a mediation. Ms Newman and her team, including an expert barrister, negotiated a settlement of $210,000.
