Investigation into CBA’s Unfair Fees on Low-Income Accounts
Gerard Malouf & Partners is investigating a potential class action on behalf of low-income customers with the Commonwealth Bank of Australia (CBA). These customers were unfairly charged fees when they were eligible for fee-free banking alternatives.
If you held a CBA Complete Access or Smart Access Account, received government benefits such as Centrelink and were charged account-keeping, overdraw or dishonour fees, you may be eligible to assist with this class action investigation.
This investigation examines whether CBA breached retail banking and consumer financial protections. While other banks have refunded over $93 million to affected customers, CBA is reported to have withheld approximately $270 million in fees charged to low-income account holders.

To be eligible, you must:
- Currently receive (or previously received) benefits through Centrelink
- Have (or previously held) a Complete Access or Smart Access Account
- Were charged any of the following fees:
- Account-keeping fees ($6 per month)
- Overdraw fee ($15 for negative account balance)
- Dishonour fee ($5 when transactions failed due to insufficient funds).
