What pedestrian injury compensation can I claim?
Under the Motor Accident Compensation Scheme, pedestrians injured on our roads are entitled to receive the same compensation as other road users.
Compensation entitlements will depend on if the injuries sustained are defined as ‘non-threshold’ or ‘threshold’ injuries.
Pedestrian injuries that are accepted as non-threshold injuries include:
- a broken bone or fracture;
- a tear to discs, tendons or ligaments;
- a head injury;
- nerve damage;
- scarring;
- vision/hearing loss;
- internal organ injury;
- diagnosed PTSD resulting from the accident
Pedestrian accident compensation claims may cover you for:
- Reimbursement of hospital, medical and rehabilitation expenses
- Compensation for any future medical expenses in relation to injuries sustained in the accident
- Compensation for past economic loss such as loss of wages while you recover from your injuries
- Compensation for future economic loss where your working life has been reduced as a result of your injuries
- Lump sum compensation if you have suffered a permanent impairment as a result of your injuries
- Lump sum compensation for your pain and suffering
