Sydney Man trips on Council footpath and receives $400,000 in compensation

A Sydney man received $400,000 by way of compensation for the injuries he sustained in a public liability accident.

Our client was jogging down a street when he tripped over a high piece of lifted concrete. Our client sustained a serious injury to his right ankle as a result.

He consulted the expert solicitors at Gerard Malouf & Partners and a claim was filed in the District Court of New South Wales.

Our client had to take several months off work and then returned to work on light duties. A claim could, therefore, be made for his past loss of income as a result of this accident.

Upon his return to work, he had continued difficulties and was unable to return to his usual pre-accident role. He suffered from a diminished earning capacity as a result of this accident and so was also able to make a claim for future loss of income.

Our client also required domestic assistance around his home from family members to undertake the tasks he was no longer capable of doing.

An expert report was obtained to comment on the condition of the footpath at the time of the accident and the obligations of the Council in relation to maintenance and repair.

The defendant disputed liability in the case and filed a Defence.

  • Past and future medical expenses;
  • Past and future domestic assistance; and
  • Past and future economic loss.

An agreement was reached between the parties for a settlement amount of $400,000 inclusive of legal costs and disbursements. This was an excellent result for our client.
