Our client was born at 40 weeks’ gestational age. She was born with Quadriplegic Dystonic Cerebral Palsy, associated with complications which developed during her birth and delivery.
During the birthing process, our client’s mother was administered with penicillin. Not long after, she had an anaphylactic reaction. Once her mother entered into a period of maternal hypotension, there was a risk of harm to her baby. Two significant events of bradycardia (oxygen deprivation to the foetus) occurred however, no attempts were made to deliver the baby by caesarean section. The obstetrician continued with the normal birthing process of a vaginal delivery. Her brain deprived of adequate oxygen; our client suffered hypoxic ischaemic damage at birth. A period of 3 days later, she was transferred to the Royal North Shore Hospital NICU due to the onset of myoclonic seizures.
Unable to articulate her needs, our client communicates via vocalisation of sounds and looking at objects. She has failed to reach most of her developmental milestones and requires full assistance from her family and carers along with the use of assistive equipment to engage in activities of daily living. This will continue indefinitely.
The medical negligence team at GMP, headed by Leslie Abboud with 30 years’ experience worked tirelessly on this case. The force of the firm’s resources and personnel were deployed as clinical records and medical reports were obtained and analysed and medical specialists at the top of their field were briefed in order to ensure that justice was done for our client and her family. After a tough fight, this matter settled following a Mediation on 14 June 2019. The parties came to an agreement that the defendants would pay the plaintiff the sum of $9,000,000.00. This money does not alleviate the pain and suffering of the family, but it does ensure that she will get the support that she needs for the remainder of her life.
Our firm is recognised as an Australian leader in its areas of law with offices throughout the east coast of Australia specialising in Sydney, country New South Wales, South East Queensland and Victoria.
