53 Year Old Woman Receives $175,000 After A Slip And Fall At A Shopping Centre In Sydney’s West

In 2018, our client was walking through a major shopping centre located in Sydney’s Western Suburbs, when she slipped on a liquid substance causing her to fall to the ground and sustain serious injuries to her left knee.

Even though there was a wet floor sign in the vicinity of the fall area, our client was unable to see it due to a concrete column, other customers walking through the area and the café seating surrounding the area.

Our client came to us for advice one month after the incident when her left knee injury had not resolved, and her symptoms were becoming worse. Our client was also becoming increasingly frustrated with the impacts this injury was having on her day to day life.

In particular, this injury had impacted our client’s ability to work as a bar attendant especially as this role required our client to stand for long periods of time. This also impacted on her ability to attend to chores around the home as our client’s left knee symptoms were often aggravated after working long shifts.

The matter was robustly defended by the cleaner who claimed that they had discharged their duty to our client, as their employee had been in the area merely 3 minutes prior to our client’s incident and had placed a wet floor sign in the area to warn customers.

The Public Liability Team at Gerard Malouf and Partners fought hard for our client, critically analysing the CCTV footage of the incident and attending views to get every angle of the area so that we could prove that the mere presence of a wet warning sign was not enough to keep our client safe.

These steps were crucial to our client’s claim as it confirmed that the wet floor sign was placed behind a concrete column which made it difficult for our client to see the wet floor sign and was not warned of any slippery substances on the floor.

Once we had obtained all the relevant evidence, this enabled us to successfully negotiate with the Defendant, obtaining an optimal settlement for our client. Our client was pleased with this result, as this sum of money will allow our client to obtain assistance around her home.
