Western Sydney man receives $79,000 in compensation for hospital’s negligence

Our client, an 80 year old man from Western Sydney has received $79,000 in compensation after he received negligent treatment from a local hospital. Our client sustained a serious laceration to the back of his leg near the ankle when he fell down some stairs at home. The laceration was quite large at over 6 cm long and 2 cm deep.

He attended hospital where he was treated for the wound and sent home. However, only 3 days later our client was back in hospital again as he had developed a significant infection in his leg which was confirmed to be a staph infection.

Our client required further treatment including wound cleaning, draining of fluid, dressing of the wound and ultimately a skin graft. It took over 3 months for our client’s wound to heal. All this treatment was necessary because the hospital failed to adequately treat his wound when he was first admitted.

In order to get some compensation for his negligent treatment, our client contacted Gerard Malouf and Partners to represent him. We took on his case and sought the opinion of one of our expert doctors.

Our expert prepared a report detailing the failures of the hospital staff and the negligent treatment our client received. After reviewing the clinical notes from the hospital he found there was a failure to clean our client’s wound properly which resulted in the need for further treatment. Our client should have been seen by a general surgical or orthopaedic registrar for assessment before being sent home.

We commenced proceedings in the District Court to recover compensation from the hospital. Our client was examined by several other doctors who reported on the damage he suffered as a result of the hospital’s negligence.

Gerard Malouf & Partners were then able to successfully negotiate a settlement at mediation whereby our client received $79,000 in compensation for the hospital’s negligence. By negotiating this settlement we were able to ensure that our client’s matter had a swift resolution and avoided the cost of bringing the matter to a hearing.
