Slip & Fall on Wet Floor in Shopping Centre – Settlement of $120,000

Our 30-year old client slipped on a wet floor in a shopping centre and sustained an injury to her right knee.

Slip Fall Medical issues

Our client sustained a tear in her right knee which required surgical repair. She had previously had surgery to her right knee 3 years as a result of a previous netball injury but said she had fully recovered from that surgery by the time she fell on the wet floor in the shopping centre.

Slip Fall Court proceedings

We commenced Court proceedings against the shopping centre and cleaners and claimed negligence for failing to remove the spillage, to inspect the floor surface and have a proper cleaning system in place to identify spillages.

The Defendant denied negligence and claimed our client failed to keep a proper lookout and take precautions for her own safety and failed to act in a manner consistent with a reasonable person exercising care and prudence.

Slip Fall Settlement

Once the Court allocated a hearing date for our client’s matter, the Defendant became interested in attempting settlement of the claim. At an Informal Settlement Conference, despite the Defendant indicating their doctor was of the view our client had sustained a small tear in her right knee, which may have been present at the time of her fall at the shopping centre, an offer was made to settle the claim for $90,000.
