Case Overview
- Our client was driving his vehicle when a car on the opposite side of the road veered into his lane, causing a head-on collision.
- Both our client and his wife sustained significant physical and psychological injuries as a result of the accident.
- After engaging in an informal conference settlement, our client’s claim was settled for $500,000.
At approximately 7:40 am on a Saturday morning, our client and his wife were travelling in an easterly direction along New Canterbury Road. As they were near the intersection at Regent Street in Petersham, a car travelling on the opposite side of the road veered into their lane, causing a head-on collision.
Our client sustained extensive physical injuries to his head and upper body, including to his cervical spine, right and left hand, lumbar spine, and right foot and knee. Moreover, our client sustained psychological injuries including shock, anxiety and post-traumatic stress disorder.
The insurer accepted liability and conceded that our client had in fact sustained serious injuries which were not minor in nature. Therefore, our client was entitled to statutory benefits as well as a claim for damages.
“Our client was entitled to statutory benefits as well as a claim for damages.“

Our Approach
Our office obtained medical evidence to support our client’s level of impairment. It was evident that his earning capacity and ability to work as a full-time scientist were impaired due to the injuries he sustained and the restrictions he experienced.
Moreover, our office gathered evidence of education and pre-injury employment details. The aim was to provide the defendant’s solicitors with an understanding of the field of work our client is qualified in.
In 2022, we engaged in an informal settlement conference with the insurer. After negotiating to maximise his compensation, our client’s claim was settled for $500,000.

More Information
Each motor vehicle accident claim requires a police report, accident notification form and personal injury claim form. The claim form is central to your claim and we recommend speaking with a lawyer to ensure the best chance of success. Once you lodge your claim, an Independent Medical Assessor reviews your claims.
Immediately following a car crash, call the police if you suspect the other driver is under to influence, and call for paramedics if you suspect you have an injury.
Following this, calling your insurer is advised, as well as taking details from other parties and witnesses. Note down any details including time, data and take photos of the scene.
If you have suffered an injury at work, or while making your commute to or from work, you’re entitled to workers compensation. This may seem like stating the obvious, but there are members of the public who are completely unaware of what accident compensation they are entitled to if anything were to ever happen. If you can’t perform the daily tasks that your job requires, you may be able to claim a Total & Permanent Disability (TPD) benefit.
