Passenger Awarded $325,000 in Compensation Following a Car Collision

Our Approach

Due to the nature of her injuries, she was assessed as having sustained a non-threshold injury and was entitled to reasonable and necessary medical and treatment expenses by the CTP insurer of the driver. 

Our client was unemployed at the time of the accident, therefore was not entitled to a claim for economic loss, but instead was eligible to make a claim for damages to compensate her for the pain and suffering she endured as a result of the accident. However, the latter component was subject to impairment being assessed as being greater than 10% of her whole person.

Despite the client’s significant injuries, there was great resistance from the insurer, and they refused to accept that her impairment was greater than 10%. We gathered an abundance of medical evidence to support our client’s claim and presented this to the insurer and to the Personal Injury Commission. After being confronted with the copious amount of evidence in support of our client’s claim, the insurer had no choice but to concede that our client’s impairment was greater than 10%.

The Result

We secured a settlement of $325,000 for our client.
