A Sydney Passenger Compensated With $165,000 After a Vehicle Accident

Case Overview
  • Our client was a passenger in a vehicle that was involved in a motor vehicle accident.
  • Our client sustained significant physical injuries.
  • By way of an informal settlement conference in 2022, our client’s matter was settled in the sum of $165,000.

Our client from Western Sydney was a passenger in a vehicle that was involved in a motor vehicle accident which occurred in 2018. In this matter, the driver at fault was driving in the opposite direction and had clipped the median strip, entering our client’s lane. The driver of the vehicle which our client was in had attempted to steer the vehicle to avoid a collision, however, it was unfortunately unavoidable.

Our client sustained significant physical injuries to his lower back, hips, pelvis, leg, knee and femur. Further, the young man sustained psychological injuries including anxiety and depression. To treat all physical injuries sustained as a result of the collision, our client was transported to Westmead hospital where he underwent surgery.

“In 2020, the CTP insurer had accepted liability, however, failed to concede that our client had sustained injuries which were not minor in nature.”

Our Approach

Upon receiving notice in relation to the CTP insurer’s position not to concede, our Motor Vehicle Accident’s team immediately requested an internal review. Further, our team continued to collate and obtain evidence which indicated the level of impairment our client experienced due to his injuries and their impact to his physical wellbeing.

The Result

More Information

Pedestrians can sustain injuries in a number of ways, including hit and run incidents or being struck whilst crossing the road. If you’ve been injured in a motor vehicle accident, you’ll be glad to know that victims have the opportunity to receive compensation as part of the motor accidents compensation scheme.

Each motor vehicle accident claim requires a police report, accident notification form and personal injury claim form. The claim form is central to your claim and we recommend speaking with a lawyer to ensure the best chance of success. Once you lodge your claim, an Independent Medical Assessor reviews your claims.

Immediately following a car crash, call the police if you suspect the other driver is under to influence, and call for paramedics if you suspect you have an injury.

Following this, calling your insurer is advised, as well as taking details from other parties and witnesses. Note down any details including time, data and take photos of the scene.
