Our client, despite informing staff she felt dizzy after undergoing radiological investigations were carried out, was left on her own in a small dressing cubical. It was apparent that shortly after staff left our client unattended and on a bench seat, our client has fainted, falling forward onto the ground. The fall resulted in our client suffering a fracture to her lower leg.
As a result of the type of fracture suffered, our client was left with ongoing chronic pain and significant restrictions in their day to day life.
As a result of the devastating effects of the injuries on their quality of life, our client sought expert advice and assistance from Gerard Malouf and Partners. Solicitor Susan Newman took on the case, arguing on behalf of her client that the treatment and care provided was below the standard of accepted clinical practice in Australia and that such a failure resulted in serious injuries to her client.
We obtained expert opinion in support of this argument, in which it was supported that our client should never have been left alone in a change cubical after the complaints she had made of feeling dizzy. Further, the expert evidence suggested that our client should have been placed on either a bed to rest or a reclined chair so as to avoid the possibility of the patient slipping forward in the event that they in fact fainted. On the basis of this expert evidence, we were able to commence proceedings against the radiology practice.
The matter was rigorously defended, nevertheless, Ms Newman and her team were able to negotiate a settlement in favour of our client in the sum of $340,000.
