In 2018, our client sustained a fracture to his right leg as a result of fall at home and accordingly was taken to hospital and underwent x-rays which confirmed that he had fractured the base of the neck of the femur. Consequently, he underwent an internal fixation of the fracture surgery where a short gamma nail and a 130-degree angled lag screw was inserted by his Orthopedic Surgeon.
Following the surgery and rehabilitation, our client continued to be in severe pain and went back to have an x-ray which unfortunately revealed that the lag screw had backed out of its set position. Due to the set screw not being implanted correctly, it resulted in our client suffering from an infection, as well as significant shortening of his right leg.
Our client approached Gerard Malouf and Partners wanting to seek compensation for a surgical error that resulted in permanent shortening of his right leg for the rest of his life.
Our client’s matter was handled by one of our very experienced Medical Negligence Solicitors, Mr Antonin Sebesta and his team. Mr Sebesta and his team worked diligently to provide our client with the best outcome possible by not only preparing the case well but by ensuring the process was as efficient and easy for our client.
During the proceedings, the parties agreed to participate in a mediation. At this time, Mr Sebesta and his team which also included an experienced barrister were able to negotiate a settlement in the sum of $215,000. Our client was very pleased with the outcome and was able to use his compensation to assist him for future expenses that he would inevitably incur as a result of his Orthopedic Surgeon’s negligence. In addition, the compensation also assisted our client to put this incident behind him and move forward with his life.
