Our client had a close relationship with his father throughout his childhood. Although our client’s father did not approve of our client’s choice of wife they maintained a close relationship. Our client fell out with his father a couple of times over the years largely due to arguments between our client’s mother and wife. However, for the large part our client visited his father approximately twice a week.
Following his mother’s death our client became closer to his father and wanted to be there for him. This remained the case for approximately ten years, at which point our client’s father formed a romantic relationship with a woman who resided overseas. One day to the surprise of our client his father advised him that he was moving overseas to be with this woman. At the same time our client’s father advised our client that he had transferred his property to our client’s older sister.
At the time of bringing his claim our client was a middle aged unemployed man. Both our client and his wife suffered ongoing health issues. Our client and his wife had down-sized in order to pay off some of their debts. However, they still had over $1million of debt owing.
