Young Sydney man receives substantial amount of compensation after unsuccessful elective treatment for hyperhidrosis

This very sad case involved a young man who had suffered from a condition called hyperhidrosis, an excessive sweating condition which he particularly suffered from in the underarm area. As his condition was increasingly impacting his day to day life, he consulted with a vascular surgeon to enquire about his options pertaining to treating or curing his condition. His treating vascular surgeon advised him that there was a procedure he could undergo which involved removing a large portion of his over-reactive sweat glands which would significantly improve his condition. Our client elected to undergo the procedure, however he ultimately suffered from a side-effect which caused him compensatory sweating in additional parts of his body and unfortunately he was left in a much worse condition than he was prior to the operation.

Unfortunately, our client was not warned about the risk of this particular side effect and the operation was irreversible. As a result, he is now forced to live indefinitely with an exacerbated condition of the disorder he desperately wished to resolve.  His worsened condition has rendered him completely unable to return to work or enjoy many of the day to day recreational activities he once took part in.

Based on the devastating outcome our client suffered as a result of this procedure, he contacted Gerard Malouf and Partners to enquire about whether he was entitled to compensation in relation to his injuries as a result of potential medical negligence. Julie Baqleh, Accredited Personal Injury Specialist, took carriage of the matter without hesitation.

After hearing the details of our client’s circumstances, particularly the failure to warn about potential risks and complications of this type of procedure, Ms Baqleh was of the view that our client had reasonable prospects of success based on the treating surgeon’s negligence which lead to our client suffering from further injury. She qualified a respected expert vascular surgeon who prepared a report on negligence.

We had our client assessed by an expert dermatologist and psychiatrist in order to determine the extent of his injuries and future treatment required. Mindful of the expenses associated with litigation, we arranged for the parties to participate in a Mediation in order to attempt to resolve the matter without proceeding to hearing.

After lengthy negotiations, we ultimately secured a substantial settlement figure for our client which compensated him for his past and future wage loss, psychiatric treatment and his injuries and suffering. His entire family was very thankful and appreciative of our assistance to help them move forward with their lives.
