Young motorcycle rider receives $665,000 in compensation after being hit by motor vehicle

We acted for a 21 years old man, Mr R who was hit by a motor vehicle whilst riding his motorcycle along a suburban Western Sydney street. Mr R was turning right when another vehicle failed to stop and give way and collided with our client’s motorbike, knocking him to the ground unconscious.

He contacted Gerard Malouf and Partners to seek legal advice about his rights and entitlements and was assisted by a Senior Personal Injury Specialist, Mr Ray Abbas who helped him lodge a personal injury claim form with the CTP insurer.

Due to the obvious negligence by the driver of the vehicle at fault, the CTP Insurer admitted liability in the matter and a Section 81 Notice was issued.

Prior to the motorcycle accident injury our client was independent, fully capable of carrying out physical activities and was employed on a fulltime basis as a labourer. As a result of the subject accident, Mr R was unable to return to work due to the physical demands of his employment.  

Due to the severity of the injuries and ongoing disabilities suffered by the claimant and the impact that the accident had on his ability to participate in employment and domestic opportunities, Mr Abbas organised for our client to be assessed by an Orthopaedic Surgeon, a Plastic and Reconstructive Surgeon, an Occupational Therapist and a Psychologist to understand the full extent of his injuries and the impact that the accident has had on his life.

Our client’s injuries were assessed to be over the 10% whole person impairment threshold. These reports were immediately served on the CTP insurer requesting that they concede that our client’s injuries exceeded the 10% threshold.  Upon receipt of these reports, the CTP insurer agreed that he had suffered serious injuries and conceded that his Injuries exceeded the threshold.

Understanding the strength of the medical evidence gathered, we advised our client that he should participate in an informal settlement conference with the insurer to try and resolve the matter early. The insurer willingly participated in an ISC and we accepted an offer in the amount of $665,000.00. This was a great outcome for the injured motorcycle rider as the matter was resolved early without the need of incurring high legal costs and ensured that his future economic loss and out of pocket expenses were accounted for.
