50 year old woman wins public liability lawsuit after office building slip

PUBLISHED 05 Jul 2020

Our client contacted Gerard Malouf and Partners after she slipped and fell outside an office building, as she made her way into the building she slipped because the floor was wet.

After conducting various initial enquiries, it was clear that the tiled surface that was used at the entrance of the building was not appropriately slip resistant. This is a common problem in buildings.

After providing our client with initial advice about her rights and entitlements and after advising her of how a public liability matter is prosecuted, we received instructions to act on behalf of the client.

The public liability team at Gerard Malouf and Partners obtained medical evidence and liability evidence to prepare the case. After putting the defendant on notice, formal proceedings were commenced in the District Court of NSW.

At first the Defendant did not want to participate in settlement discussions. The case was prepared for hearing and after all the evidence was served, the Defendant approached our firm to try and negotiate a settlement.

After an exchange of offers, our client was very happy with the result.
