Passenger receives $200,000 compensation in a rear end collision

Mrs S contacted our offices after she was involved in a rear end collision when she was a passenger in a vehicle being driven by her husband.

As a result of the accident, Mrs S suffered pain in her mid-back and lower back for which she was transported to hospital. Hospital records revealed wedging in her spine and after two days of investigations Mrs S was discharged to the care of her General Practitioner.

The pain did not subside and Mrs S was struggling performing her day to day duties as a laundry worker. After persisting with her duties and the pain, she realised that her condition was slowly deteriorating and for that reason, she contacted the offices of Gerard Malouf & Partners to ascertain whether she was entitled to any compensation and she was worried that if she lost her job that this would place her and her family in extreme financial pressure given that she had to look after her family.

We at Gerard Malouf & Partners compensation lawyers Sydney advised Mrs S that she had a viable claim that should be vigorously pursued against the CTP Insurer. We indulgently and expeditiously lodged a Personal Injury Claim Form on Mrs S’ behalf. When Mrs S injuries stabilised, we arranged for her to medically assessed by an Orthopaedic Surgeon, a Psychiatrist, an Occupational Physician and an Occupational Therapist. The insurer assisted Mrs S by providing her with an advance payment and this assisted greatly because of the financial pressure that she was experiencing. Prior to receiving the medical reports, the insurer expressed an interest in attempting to resolve the matter. A settlement conference was heard over the telephone on 30 May 2014 and after extensive negotiations Mrs S decided to resolve the matter. The matter resolved within twelve (12) months from the date of the injury and Mrs S was thrilled with the result.

We at Gerard Malouf & Partners compensation lawyers Sydney were able to use our expertise to ensure that Mrs S’ matter quickly resolved in the quickest possible time and for as much money as possible. Mrs S was happy with the result and despite receiving advice from our firm that her claim was possibly worth more she was still happy to accept the offer in such a quick time and move on with her life in order to avoid suffering further financial hardship by allowing the claim to take its course through the normal legal system. The matter resolved in the sum of $200,000.00 and Mrs S was able to move on with her life.
