Our client, Mr R of Newtown was a 41 year old man who was employed as a Linen Services Attendant.
In February 2017, Mr N was the rider of a motorcycle involved in a two-vehicle head on traffic collision that caused him to separate from his motorcycle and become airborne. He was taken by air ambulance to the nearest Hospital. As a result of the accident, Mr N sustained significant injuries requiring hospitalisation for a period of over 7 months.
At the time of the accident, Mr N had been working 36 hours per week at a Private Hospital as a Linen Services Attendant. These duties required him to collect linen from all wards, transfer them to the laundry section and assist in loading these onto the trucks which transported the linen to the laundry services. The nature of Mr N’s role was physically demanding however following his accident, he sustained various injuries to his neck, back, arms, legs, feet and was also experiencing difficulty mobilising.
Mr N initially retained the services of Gerard Malouf and Partners in respect of his injuries arising from the Motor Vehicle Accident however our expert solicitors wasted no time in identifying the potential further claims for Mr N in light of his extensive injuries and inability to return to work.
Upon detailed investigations, our solicitors were able to confirm that Mr N held active insurance for Total and Permanent Disablement with two Superannuation Funds at the date of his accidents and ceasing of work.
Mr N’s injuries were such that it was unlikely that he would ever be able to return to his pre-accident employment and would find it difficult to return to any form of employment.
Following his accident, Mr N continued to be under the review of orthopaedic surgeons, plastic surgeons, physiotherapist, and psychiatrists in terms of his depression and post-traumatic stress disorder.
It was to Mr N’s great relief when Gerard Malouf and Partners undertook the preparation of the claims against both Superannuation Funds and lodged the claims for assessment.
In a matter of months after lodgement, with the help of his expert Lawyers, Mr N successfully claimed a combined total of approximately $400, 000.
