Our client, Mr N of Dean Park was employed with the Department of Education as a Learning Support Officer dealing with developmentally disabled students.
Prior to commencing with the Department of Education, Mr N worked in various labouring roles and truck driving.
As part of his role as a Learning Support Officer, Mr N was required to undertake tasks including tube feeding, administering medication, toileting, maintaining registers, photocopying, playground supervision, out of school activities, lifting equipment, first aid duties, kitchen duties, assisting students at mealtime as well as any other activities required.
The work environment was stressful with limited support. Despite reaching out for assistance, Mr N was unaided and continued to struggle. He later began to find himself the subject of workplace bullying and harassment and was eventually diagnosed with stress, anxiety, depression and personality disorder. Mr N became socially withdrawn, suffered from insomnia and experienced a severe deterioration in the quality of life.
As a result, Mr N ceased all employment in 2015 and has been unable to resume work duties since.
Mr N eventually approached and retained the services of Gerard Malouf and Partners who wasted no time in preparing and resolving a claim for worker’s compensation which was accepted by the insurer.
Arising out of Mr N’s inability to return to employment, his limited educational background and work experience, our expert solicitors quickly identified the potential for a claim for Total and Permanent Disablement against Mr N’s Superannuation Fund.
The expert solicitors at Gerard Malouf and Partners made contact with the active Funds held by Mr N and identified where insurance was held and commenced the claims process.
A claim was lodged against the Fund and approved in less than 3 months from the date of lodgement. As a result of this acceptance, our client will be paid lump sum insurance payment to the value of over $160,000.00
