Woman sues for compensation after she trips over step in deli and shatters glass in her hand

PUBLISHED 13 Jul 2018

Just before the end of 2016 a 65 year old lady asked us to help her.  She had being shopping in her local delicatessen.  She had already picked ups some jars of food.  As she walked around the corner of the aisle, she tripped over a movable step which had been left in the middle of the aisle.

That step had been left there by one of the employees who had earlier in the day had been stacking shelves.  As is the normal case, our client was looking at the items on display for sale which is what the delicatessen wants all of its customers to do.

As our client fell to the floor, the hand in which she was carrying a jar hit the ground first and the shattered glass caused serious cuts to her right hand.  Our client went straight to hospital and it was obvious that it was a very serious injury which required immediate surgery to repair tendons and nerves which had been cut through.

We were retained under our “No Win No Fee” personal injury compensation costs agreement and we took care of all costs associated with the preparation of our client’s claim.

At Gerard Malouf & Partners Compensation Lawyers, we believe that the first interview is the grounding of a successful claim.  We spent considerable time interviewing our client to obtain full details of her accident and how the injuries had affected her life including her ability to continue with work.

At Gerard Malouf & Partners Compensation Lawyers are familiar with cases that involve similar sets of circumstances.  Our investigations revealed that not only had the step been regularly left in the store where customers walked, but it could be locked into position which simply made it easier for people to trip over.

The quality and details of our instructions played a key role in this matter as we were able to address both the strengths and weaknesses of the case.

Our client’s injuries have led to a loss of enjoyment of her every-day life.  She now has difficulty undertaking heavier housework because of weakness in her hand.  This also restricts driving because holding the steering wheel for more than a short time is very painful.

Our client’s work was also affected because she’s employed in IT and spends her entire day using a keyboard.  At the end of the day, the pain can be quite severe.   For quite a few months after the injury, our client was unable to work at all while she recovered from the surgery.

As a result of our expert and negotiation abilities, and the high calibre barristers we insist on using, we were able to settle our client’s claim for $80,000.00.

Our client was very happy with the outcome of the case.  The compensation she received recognised how her private life and work life had been effected and gave her the ability to know that she some ability to not need to be constantly anxious about her work and life future.
