Woman receives settlement of over $50,000 after slipping at Western Sydney shopping centre

PUBLISHED 24 Apr 2017

This matter involved a woman who slipped on a discarded piece of fruit at a Western Sydney shopping centre. As a result of slipping, she fell heavily to the ground and suffered serious injuries to her right knee.

Our client underwent an MRI on the right knee as well as a bone scan which indicated that she had damage to the cartilage and retention of fluid in her kneecap. These injuries substantially diminished her ability to lead a normal life. She had difficulty performing domestic duties and was also unable to participate in social, recreational, and sporting activities that she normally enjoyed such as attending the gym, going on walks, and attending race car events. As a result of these injuries she was advised that she would have to undergo lengthy rehabilitation treatment to regain full movement in her shoulder.

Distressed about her injuries, she approached Gerard Malouf and Partners where Julie Baqleh, an Accredited Personal Injury Specialist, took carriage of the matter. She briefed an experienced senior barrister to assist on the matter and quickly obtained all relevant medical records of the client.

Ms Baqleh then proceeded to brief expert medical practitioners to assess the degree and longevity of the injuries suffered by our client as a result of the fall. Ultimately, she was able to provide evidence that indicated that the client’s injuries were caused by the negligence of the Defendant. In order to save our client the burden of lengthy and expensive court proceedings, Ms Baqleh invited the Defendant to participate in an informal settlement conference where she negotiated a fair and reasonable settlement figure of over $50,000 which the client was very happy with.
