Western Sydney man receives $900,000 in compensation after a motor vehicle accident

Case Overview
  • Our client was riding his motorbike when another vehicle from his left cut him off.
  • Our client swerved in an attempt to avoid the collision; however, he fell on the right side of his body and suffered severe injuries
  • By way of an informal settlement conference, our client’s matter was settled for $900,000.

At approximately 3:00 pm on a Tuesday afternoon, our client was riding his motorcycle, when a car pulled out of a parking spot on his left and then abruptly stopped in our client’s path. Our client rode around the motor vehicle to avoid collision. As he attempted to straighten up, he fell off his motorcycle. He slid along the road with the motorcycle on top of him before hitting a gutter.

Our client sustained extensive physical injuries to his upper body, including his cervical spine, right hand, right leg, and shoulder. Further, our client sustained psychological injuries including anxiety and depression around riding his motorcycle.

The insurer accepted liability and accepted that our client had in fact sustained serious injuries which were not minor in nature. Therefore, our client was entitled to statutory benefits and a claim for damages.

“The insurer accepted liability and accepted that our client had in fact sustained serious injuries which were not minor in nature.“

More Information

Each motor vehicle accident claim requires a police report, accident notification form and personal injury claim form. The claim form is central to your claim and we recommend speaking with a lawyer to ensure the best chance of success. Once you lodge your claim, an Independent Medical Assessor reviews your claims.

Immediately following a car crash, call the police if you suspect the other driver is under to influence, and call for paramedics if you suspect you have an injury.

Following this, calling your insurer is advised, as well as taking details from other parties and witnesses. Note down any details including time, data and take photos of the scene.

Where a vehicle cannot be identified, the legislation provides a nominal defendant, which is most cases is the Motor Accidents Authority. A nominal defendant is a substitute for the other party.
