In this matter, our client suffered an accidental cut to her ring finger at home and presented to the emergency department of her local hospital for treatment of her injury. The presenting doctor attended to cleaning, gluing and stitching of the wound. No attempts to examine and diagnose any underlying injuries to the tendon or joint were done, nor were any antibiotics or painkillers prescribed to our client.
After the presenting doctor at the hospital performed this procedure, our client noticed that something was not right. She continued to experience worsening pain and discomfort, and complained to her local general practitioner. The doctor, noting our client’s pain and inability to fully extend her finger, referred her again to the local hospital. Unfortunately it took several days to diagnose that the tendon in our client’s finger was damaged at the time of the initial injury.
This damage necessitated in our client undergoing a series of surgeries to repair her finger, to eradicate the infection in her finger and to reconstruct her finger to allow for full extension.
Unfortunately for our client, the surgical attempts were unsuccessful at solving the injury and our client continues to experience ongoing pain and inability to fully extend her right finger.
With this clear mistreatment, our client sought the expert advice and help from Gerard Malouf and Partners. Medical negligence lawyer Keegan Behrens took on this case and argued on behalf of his client that the hospital was medically negligent in failing exercise adequate skill and care in exploring and examining the injury for any damage to the tendon.
It was decided that the best option for our client to reach a positive outcome would be to enter into settlement negotiations between the parties by way of an informal settlement conference. Compensation lawyer Keegan Behrens and his team, including an expert barrister, negotiated a settlement of $175,000, which our client was very pleased with.
