A competent GP knows when they need to call for a specialist. In this case our client was successfully able to claim compensation against a country GP and hospital in the Southern Tablelands for failure to make such a referral.
In January 2014 our client consulted her GP due to an ache in her left ear. During the consultation, the GP attempted to remove a foreign body in the Plaintiff’s left ear using forceps. This attempt was unsuccessful, and caused pain and bleeding in the ear as a result of perforating the Plaintiff’s ear drum. Despite this, the GP did not refer our client to a hospital or to an Ear, Nose and Throat Specialist.
After the consultation our client presented to a regional hospital in the Southern Tablelands with nausea, vomiting and dizziness. Though the hospital suspected an injury in her eardrum they negligently referred her back to her GP for a specialised referral.
It was not until April 2014, when our client presented to an Ear, Nose and Throat clinic, that a proper diagnosis was made and proper treatment was provided: removing the foreign object with wax. Although the foreign object was removed, the eardrum was now damaged and our client continued to suffer from partial deafness, nausea and throbbing at her left ear.
Knowing that she had not received competent clinical practice, our client contacted Gerard Malouf & Partners and spoke to our experienced medical negligence solicitor, Mr Leslie Abboud. From her account, Mr Abboud immediately recognised that the GP did not ensure proper vision of the left ear when attempting to remove the foreign body and that the hospital should have referred her immediately to an Ear, Nose and Throat specialist.
Mr Abboud contacted Mr Andrew Campbell, a leading barrister in medical negligence. Together, they settled our client’s matter at mediation for the sum of $30,000 without the need for trial.
