Our client purchased a vehicle from one of the Defendants in February 2014. At this time, he was not advised that the vehicle had a defect which result in a serious risk of collision and harm to passengers.
Our client received a recall notice from the car manufacturer, advising him of the fault. He was informed that the engine would lose power, which would effect the power brakes and power steering and make the car difficult to manage. He took the car to be serviced so that modifications could be made. However, on multiple occasions he was advised that these modifications could not be actioned according to the recall notice.
Just over two years later, our client was driving his vehicle on the Old Hume Highway when the engine automatically shut down. This resulted in a steering and braking failure and caused him to collide with a road barrier.
