Man from South Coast NSW awarded $565,000 in compensation for serious motorbike accident

Gerard Malouf and Partners Compensation Lawyers acted Mr T who was involved in a serious motor vehicle accident in 2015 in Shellharbour. Mr T was riding his motorbike home along a busy highway when another motor vehicle ignored a “give way” sign and came through the intersection and collided into our client’s motorbike, causing him to suffer serious and life threatening injuries to the neck, spine, left arm, left wrist, left leg and psychological injury. 

Ambulance attended the accident scene and Mr T was conveyed to hospital where he underwent scans and a surgical procedure to his left arm.

Due to the serious injuries sustained in the accident Mr T was unable to return to work at any capacity and requires extensive personal and domestic assistance from his family members.

Action Taken:

With the help of our Accredited Specialist Personal injury Lawyers, a personal injury claim form was lodged against the CTP insurer. Pursuant to a Section 81 Notice, the CTP insurer wholly admitted that the driver of the other vehicle was at fault for the accident and admitted a breach of duty of care.

Due to the serious nature of Mr T’s injuries and ongoing disabilities, our Compensation Lawyers organised for Mr T to be medically assessed by an Orthopaedic Surgeon, Occupational Therapist, Psychiatrist and Occupational Physician. These medical examinations provided the CTP insurer with medical evidence that shower that as a result of the accident, Mr T will continue to suffer ongoing pain and suffering, a loss of income and the need for future treatment and care.

Upon receipt of the medical evidence our Lawyers obtained on behalf of Mr T, the CTP insurer acknowledged that our client suffered serious injuries which did exceed the 10% whole person impairment threshold. Therefore, our client was entitled to damages for non-economic loss, past and future economic loss, past and future treatment and out of pocket expenses, as well as past and future domestic care and assistance.

Understanding that our client wanted the matter resolved as quickly as possible, we invited the CTP insurer to participate in an informal settlement conference. After extensive negotiations the matter resolved and Mr T was awarded a sum of $565,000.00
