GMP clients receive $68,000 settlement after exposure to asbestos

Our client was a 75 year old man who worked as a labourer in the 1960s and 1970s. During the course his employed he was required to regularly handle, unload, load clean and sweep asbestos dust and fibres that were released during the course of his employment and  used in his employers’ factories. As a result of his work he experienced a direct exposure to asbestos dust and fibres which he inhaled causing him injury.

As a result of his exposure to asbestos dust and fibres he contracted carcinoma of the lung and asbestosis. This resulted, among other things, in chest pain, breathlessness, and psychological harm. Additionally his diseases will ultimately result in his death.

Due to the nature of his diseases, his symptoms did not until many decades later and he was ultimately diagnosed in 2011. Upon diagnosis of his condition it was clear that they were caused by exposure to asbestos dust and fibres. Due to his employment history it became apparent that he was exposed while employed in two different jobs. Accordingly, we commenced proceedings in the Dust Diseases Tribunal against both employers.

We had our client examined by an expert chest physician who prepared a report detailing the extent of the damage he was now suffering from. With this and other evidence we were able to quantify the compensation that our client rightfully deserved.

Due to the terminal nature of his asbestosis we were aware of the need to obtain a speedy resolution for our client. We engaged in settlement discussions with the Defendants and were able to negotiate a settlement of $68,000 for our client. This was a great result and our client was happy to be able to finalise his matter.
