Chester Hill motor vehicle claim settles for over half a million dollars

PUBLISHED 22 Dec 2014

Our client was involved in an accident as he was driving along a major road in Chester Hill on his way to work. A vehicle travelling in the opposite direction to our client made a right turn across our client’s path, and our client’s car collided with the other vehicle. The experienced team at Gerard Malouf and Partners were able to pursue our client’s rights and bring a motor vehicle claim which settled for over half a million dollars.

As a result of the motor vehicle accident injury our client was taken to hospital by ambulance and admitted for a period of over two weeks.

Our client suffered multiple injuries, the most significant injuries were to our client’s head, back and legs. Our client also developed mental health problems as a result of his physical injuries and ongoing limitations.

The injuries impacted his life in serious ways. He worked in labour intensive jobs prior to his motor vehicle accident and while he returned to work for approximately one and a half years following his accident he eventually found that he was unable to continue as he could no longer stand the pain, he became unemployed. Our client’s injuries also had an impact on our client’s social life. He was no longer able to play golf with his friends, and socially he became recluse.

Our client contacted Gerard Malouf and Partners due to the turmoil which this accident caused in all aspects of his life. He contacted our office outside of the limitation period for making a claim. However, David Cossalter, the solicitor with carriage of this matter at Gerard Malouf and Partners, believed in our client’s claim and acted quickly to serve the Defendant insurance company with the relevant documents. As a result David was able to ensure that our client’s legal rights in relation to this claim were preserved.

We organised for our client to be assessed by our panel of medical experts. The reports produced by these experts corroborated and strengthened our client’s claim. David maintained open lines of communication with the Defendant’s solicitors, and settlement negotiations continued parallel to preparation of our client’s claim. Prior to the matter being assessed by the Claims Assessment Resolution Service, the Defendant made an offer of settlement in excess of $600,000. Our client was very happy with this offer and instructed us to accept it.
