Central Coast driver injured in serious motor vehicle accident awarded substantial damages

Our client was a 55 year old driver resided in Chain Valley Bay on the Central Coast of NSW when he was involved in a serious motor vehicle accident in July 2014.

He was wearing a seatbelt at the time of the accident when his vehicle was T-boned by another vehicle that was speeding through red lights and causing the accident. 

As a result of the accident our client suffered injuries to the chest, mid-back, knees, shock and a psychological injury. He was taken by ambulance to John Hunter Hospital and was admitted there as an inpatient. 

It was ascertained that he suffered a chest injury including a fracture of his ribs. He was discharged to the care of his medical practitioner. 

A Motor Accident Personal Injury Claim Form was lodged on his behalf which subsequently resulted in the CTP Insurer issuing a S81 Notice and accepting liability on behalf of their insured driver in negligence for the circumstances surrounding the accident. 

The client required treatment from his doctors and specialists and was referred to have further assessment and treatment by specialists from both sides. 

The clients claim was for permanent impairment and pain and suffering, past and future out of pocket expenses, past and future loss of wages, past and future loss of superannuation and past and future care. 

The insurer was provided with documentation in relation to the clients ongoing loss of wages and incapacity. 

After our client was assessed both sides doctors, the insurer arranged for an Informal Settlement Conference to discuss an out of Court settlement of the matter. as a result of that settlement conference our client was awarded substantial damages in respect of his injuries, loss and damage.
