GMP Law lawyers represented a 53-year-old man who was involved in a serious motorcycle accident. As a result of the accident, our client sustained significant physical injuries which required ongoing treatment and rehabilitation services. Our client had lodged with the CTP insurer an application for personal benefits and a certificate of capacity. 

Due to the nature of his injuries, he was assessed as having sustained a non-minor injury and was entitled to continue receiving wage assistance and reasonable and necessary medical and treatment expenses by the CTP insurer of the driver. 

Therefore, by this determination, it meant that our client was eligible to make a claim under Common Law for damages (lump sum compensation) for the loss of both past and future wages as well as non-economic loss (pain and suffering as a result of the accident). The CTP insurer wholly admitted liability for his claim for damages.

Our Approach

Once our client’s injuries had stabilised and reached maximum medical improvement, we gathered and provided medical evidence which confirmed that our client suffered significant and permanent injuries. 

The CTP insurer conceded that the injuries sustained in the motor accident had a permanent impairment percentage greater than 10%, being the required threshold to claim for non-economic loss.

The Result

We invited the CTP insurer solicitors to participate in an informal settlement conference. After communicating various offers back and forth, we were able to reach an agreement and settled the claim for $865,000.00 inclusive of costs and statutory weekly payments.
