We were approached by the mother of a 37 year old woman who had died of metastatic breast cancer in September 2012 leaving behind a fiancé, and three children. The case was allocated to Mr Leslie Abboud, senior solicitor with over 30 years’ experience in medical negligence litigation.
Mr Abboud immediately set to work requesting the young woman’s medical records and conducting extensive medical research into the young woman’s type of breast cancer. Upon receipt of the young woman’s records, Mr Abboud retained specialist doctors and determined that the young woman’s breast cancer was of a type which was likely to metastasize, and the young woman’s doctor did not deal with a suspicious lump in her left breast appropriately. Therefore, because of the doctor’s malpractice, the young woman developed metastatic breast cancer which, despite a mastectomy and breast reconstruction in August 2012, claimed her life.
The mother was concerned about her deceased’s daughter’s fiancé and children. Her fiancé had lost the woman he was building a life with, and her children were left with without the parent who had supported them and cared for them all their lives. Given the circumstances Mr Abboud was able to mount a Compensation for Relatives Claim which claimed for the past and future economic loss of the income that the young mother would have been proving her family, as well as the non-economic loss dependency of care and attention she provided.
At mediation Senior Counsel and Counsel, instructed by Mr Abboud, presented a compelling case for the young woman’s family. They were successful in negotiating compensation in the amount of $425,000.00 plus costs at mediation which saved the young woman’s family the costs of proceeding to a medical negligence hearing. The young woman’s family were very pleased with the outcome.
