In this matter, we acted for a client who suffered injuries after falling on a slippery area of floor at the pedestrian concourse of a shopping centre. As a result of the fall, our client fell heavily on the concrete ground, causing her to suffer a number of injuries.
Our client sought a personal injury lawyer to investigate her claim and contacted Gerard Malouf & Partners for advice on her rights and entitlements to compensation.
After completing our initial investigations and obtaining our client’s instructions, we were in a position to commence proceedings against the subject shopping centre.
It was alleged that the Defendant failed to take reasonable care for the safety of our client and other patrons to the complex. This included a failure to adequately inspect and clean contaminates on the floors or warn patrons of the hazard so as to avoid the risk of harm materialising.
The Defendant strongly denied that they were negligent in the circumstances of our client’s accident.
In order to assess the extent of our client’s injuries and ongoing disabilities, we arranged for our client to be examined by an orthopaedic specialist and obtained an expert report. The purpose of this report was to ascertain a diagnosis of our client’s injuries and disabilities arising from the subject accident and provide a prognosis as to the extent that her compensable injuries will impact upon our client’s future.
Upon completion of the service of our client’s medical and liability expert evidence, we were in a position to invite the Defendant to participate in an Informal Settlement Conference with the prospects of resolving the matter. The Defendant was willing to negotiate and discuss the resolution of our client’s claim, and on the day we were able to successfully resolve the matter at this conference.
We were able to obtain a fair and reasonable settlement for our client based on the extent of her injuries and our client was pleased with the outcome of her claim.
Our client was happy to see her matter resolved without the need to proceed further to a hearing.
