40-year-old Liverpool lady receives $75,000 compensation after falling into pothole

PUBLISHED 24 Aug 2017

In 2009, our client was walking her dog around the housing complex where she resided. The complex was managed and controlled by a major housing corporation. The housing corporation contracted a maintenance company to conduct maintenance of the lawns. As she was walking on the grass lawn, she suddenly fell into a pothole.

The pothole was deep and wide but grass had grown over it at the time of the fall, thus obscuring the presence of the hole and the contents within it. There was a beer bottle inside of the hole at the time of the fall, and as a result of the injury, our client suffered a fracture on her big toe, injury to her right ankle, bruising, as well as associated psychological injury.

Our client approached Mr Leslie Abboud of our office and his team of personal injury lawyers. Mr Abboud heard her out and took the matter on a “no win, no fee” basis, meaning that our firm would undertake prepayment of expert reports, getting clinical notes and any other fees incurred over the course of the matter and expect no upfront contribution from the client.
Together, they put a claim together and alleged that the housing corporation and the maintenance company failed to take adequate precautions for the safety of the Plaintiff, and exposed the Plaintiff to a risk of injury which could have been avoided with reasonable care. Additionally, there was a failure to put barricades, signs or warnings, as well as a failure to ensure the hole was visible. Evidently, it would also seem that there was a failure to repair the hole within a reasonable time.

Mr Abboud and his team quickly paid and arranged for clinical notes and expert medical reports to be made for our client at no upfront cost.  Our client was seen by various specialists, who proved that our client had suffered physical and psychological injuries due to the negligence of the Defendant.

Upon receipt of this evidence, Mr Abboud and his team, quickly negotiated and settled upon an order outside of court for the defendant to compensate our client $750,000 worth of damages due to the defendant’s negligence.
