This matter involved a man who underwent extensive dental treatment in the Southern Tablelands between 2013 and 2015. This treatment did not bring about any therapeutic benefit or improvement to our client and caused him severe pain and a number of serious ongoing dental problems requiring further corrective dental procedures. As a result of this treatment, he developed extensive and ongoing physical problems as well as debilitating psychological injury including major depressive order and chronic pain disorder.
Understandably distressed about the outcome of this treatment, he contacted Gerard Malouf and Partners where Christine Beshay, one of our senior medical negligence lawyers and an accredited personal injury specialist, took carriage of the matter. We were able to act quickly and confirm with the injured man that we could act on his behalf in making a claim for compensation on a no win, no fee basis. Ms Beshay commenced proceedings in the District Court of NSW and began to gather evidence to determine the consequences our client would face in the future as a result of this negligent medical treatment.
As part of this process, Ms Beshay briefed a senior barrister with expertise in medical negligence. She also sought the opinion of highly regarded doctors and medical experts. Expert medical evidence revealed that the lack of appropriate comprehensive examination and treatment planning was of a very poor quality and not acceptable relative to peer professional standards. Upon reading the clinical notes of the treating dentist, there were also concerns that the records had been modified by the treating dentist.
The parties agreed to an informal settlement conference and Ms Beshay negotiated a settlement figure of $120,000 for our client. He was very pleased with these results and thanked Ms Beshay and her team for their ongoing commitment to his case and success in reaching an outcome he was satisfied with.
