National Redress Scheme for Sexual Abuse in Australian Institutions
Published 18 Dec 2018
The Federal Government following the Royal Commission into institutionalised sexual abuse has set up a National Redress Scheme to ensure that thousands of victims of sexual abuse that were underage have an automatic right to claim some predetermined damages and money from these large institutions.
The institutions in question would include public and private schools, hospitals, numerous religious organisations such as The Uniting Church, The Salvation Army, The YMCA and Scouts Australia, Catholics, Anglicans, Jewish, Muslim and Protestant groups particularly their male and female schools, Australia wide Scout movements, retirement homes, girls and boys’ orphanages and homes.
Sadly, whilst the scheme is a good initiative, the amount of money claimable is on balance significantly less than if the claimant sought the representation to of a private lawyer such as Gerard Malouf and Partners who are specialists in sexual abuse claims. On average, it is anticipated that the amount awarded for serial sex abuse could be as low as $100,000.00 whereas a thoroughly prepared and aggressive claim brought on behalf of a seriously damaged victim of sexual assault might be able to obtain upwards of $500,000.00 plus. We will protect your integrity, confidentiality and give you personalised highly compassionate support and service so that you can achieve a fair result to assist you coming to some conclusion.
If you go with the Government Redress Scheme It is highly likely that the result will not be tailor-made for you based upon pain and suffering, depression and anxiety, past and future wage loss and an amount for past and future medical treatment expenses including psychological and psychiatric assistance as well as a significant contribution towards your legal costs. The Scheme allows a public servant following various submissions, to make a determination as to the merit of your case and does not give you the opportunity to argue your claim in detail as much as engaging a private law firm such as Gerard Malouf and Partners. Whilst the path to making a claim through the Redress Scheme may appear easier, the amount of money that might be achieved will be far less than achieved at the hands of an experienced aggressive and very competent Personal Injury Law firm.
