Sydney Family Receives $150,000 In Compensation Following Double Amputation Of Father’s Legs

Published 02 Aug 2018

Our clients were a family who contacted us on behalf of their father, who was treated negligently by a general practitioner attending on a nursing home. He suffered serious infections in his feet, and was diabetic. Although this meant he required more persistent observation and treatment, this was neglected and he ultimately had both legs amputated below the knees at a local hospital.

Unfortunately, this gentleman passed away during these proceedings, but his family members were still entitled to make claims for nervous shock arising out of the mental harm they had suffered as a result of the nursing home’s negligence in poorly treating and managing their father.

The family was quite distraught with the way he had been treated, and contacted our office to seek our expertise and advice. Mr Leslie Abboud, a solicitor with over 30 years of experience in medical negligence, took their matters on a “no win, no fee” basis, confident of success and confident that a favourable settlement could be reached for the family.

Leslie and our medical negligence team worked quickly, gathering all clinical notes pertaining to the family’s late father’s treatment and contacting a medical expert in general practice who confirmed that the doctor had indeed been negligent in their mismanagement of the father’s condition.

Each family member was then referred to a clinical psychologist who confirmed the extent of the harm they had suffered and published reports outlining this, as well as what treatment they would require in future.

Leslie negotiated this matter successfully at a mediation with the legal representatives for the defendant, negotiating a $150,000 settlement to be divided between the family members. This money would be used to assist the family in accessing the treatment and therapy they need to get their lives back together and come to terms with the unfortunate and wholly avoidable incident which happened to their father.

The family were happy with the outcome and were proud that they had been able to stand up to the negligent doctor, proving to them that such negligent and unprofessional treatment was not acceptable and would not be tolerated by regular people.
