Elderly woman receives $120,000 compensation due to injury from a faulty trolley on travellator

An elderly woman has received $120,000.00 due to a faulty trolley at Miranda. Our client was using a trolley on a travellator. The brake of the trolley was faulty and did not grip. The trolley has then rolled backwards, causing our client to be knocked over and causing her to sustain serious injury to her lower leg.
Noting the age of our client, she was retired and brought no claim for economic loss. Whilst unable to claim for economic loss we were still able to claim the following:
- Pain and Suffering;
- Past and Future Out-of-pocket Expenses;
- Past and future Domestic Care and Assistance.
This woman attended upon the expert compensation lawyers of Gerard Malouf and Partners for a free consultation. During this consultation, our compensation lawyer discussed the claim generally with the client, on a no obligation basis. The client was advised from the outset that our firm operates on a no win no fee basis, and was advised that the costs of the claim would be covered by the firm for reimbursement upon settlement. Our client was happy for our firm to commence acting on his behalf.
Our expert personal injury lawyer arranged for this client to be assessed by specialist doctors, being an orthopaedic surgeon and occupation therapist, and put potential defendants on notice of legal action. These potential defendants were able to provide us with documentation that ultimately lead us to the identity of the true defendant, who in these circumstances were the company responsible for the maintenance and upkeep of the trolleys.
Once satisfied that the medical evidence and liability evidence was wrapped up, our public liability solicitor decided there was enough evidence to commence legal action in the District Court. Accordingly, documents were drafted and filed.
Once a matter is commenced in Court, the parties involved enter into a timetable to ensure evidence is served in a timely manner, and to ensure the progression of the claim. Noting the evidence we had available, the expert compensation lawyer invited the Defendant to an Informal Settlement Conference.
On the date, out solicitor was able to negotiate a settlement of $120,000.00. This was a fantastic result and one which our client was delighted to accept.
