Wagga Wagga woman received $90,000 following a failure by his medical practitioner to properly investigate her injuries

At the time of the accident our client was a 60 year old Wagga Wagga resident who was under the care of a local Optometrist.

Upon opening the file all the client’s relevant clinical were obtained a reviewed. From a review of the clinical notes it appeared in 2014 and 2015 the Optometrist completed tests which revealed increased pressure and cupping of the client’s right optic nerve head.

The Optometrist made no effort to consult with the client as to her treatment needs a requirement of this increased pressure. It was not until some considerable time later in late 2015 that the client was advised to undergo a right glaucoma drainage operation.

As as result in the delay of treatment the client sustained a loss of vision as well as psychiatric injuries.

The client first contacted Gerard Malouf and Partners in August 2016. Immediate request of all the clients clinical notes were requested, reviewed and provided to a medical expert for comment. The expert provided a report which outlined the negligence on behalf of the Optometrist.

With a supporting medical expert willing to testify on behalf of our client a Statement of Claim was produced and filed with the Sydney District Court. 

The client made claims for his ongoing out of pocket expenses both past and future, her ongoing care requirements in relation to the blindness which she had sustained as well as the pain and suffering which she had underwent as a result of the operation.

A mediation was quickly organised being just over a year from the date of the filing of the Statement of Claim and ultimately the matter settled for $90,000.
