Liverpool woman receives $80,000 injury compensation after tripping on wheel stopper in car park

A Liverpool woman has been awarded over $80,000.00 after tripping on a wheel stopper in the car park of her local shopping centre.

It was day time, and our client upon returning to her car, has tripped on the wheel stopper which was protruding out from the side of her car. As a result, she has fallen heavily to the ground, causing her to sustain various injuries, the most severe of which was to her lower left limb.

This lady attended upon the expert compensation lawyers of Gerard Malouf and Partners for a free consultation. She had photos of the wheel stopper with her to assist in determining if there was negligence in the claim. Upon reviewing the photographs, our compensation lawyer noted the wheel stopper was the same colour as the car park, and was not highlighted as per the required standards. The client was advised from the outset that our firm operates on a no win no fee basis, and was advised that the costs of the claim would be covered by the firm for reimbursement upon settlement.

Following the consultation, our public liability specialist briefed one of our liability experts to provide a report regarding the unsafe nature of the wheel stopper. Upon reviewing the documentation and attending upon the site, our expert determined that the wheel stopper was unsafe, and steps ought to have been taken by the Defendant to prevent the injury.

Accordingly, legal action was commenced.

Our client was a lady in her 70’s. She brought with her no claim for economic loss, and her claim was one for the following:

  1. Past and Future Out of Pocket Expenses;
  2. Past and Future Care and Assistance;
  3. Pain and Suffering.

Our expert compensation lawyer had her assessed by doctors to determine the extent of her injuries and to comment on her future needs, and once all evidence was finalised the Defendant was invited to an Informal Settlement Conference.

On the date of the settlement conference, the money that was being offered by the Defendant was far less than the true value of the case. Accordingly, our personal injury specialist advised this client to not accept the offer, as there would be an opportunity for future negotiations. Our client accepted our advice, and approximately 2 months after the initial settlement conference, the claim settled for over $80,000.00, being more than double the amount that was offered us at the settlement conference.
