Bondi man receives $150,000 after slip in food hall

A Bondi man has received a payout of $150,000.00 after slipping in a food hall. As our client was ordering his food, he has turned away from the counter and has suddenly slipped on a piece of lettuce which had been left on the floor, causing him to fall heavily and sustain serious injury to his back.

At the time of the subject accident, our client was on holiday. Upon return home, he was unable to perform his usual day to day work duties due to the restriction of his injuries. Accordingly, as our client was self-employed he was required to hire someone to perform work for him. Further to this, he was heavily reliant on his wife for various duties around the home. Accordingly, our client was able to claim the following Heads of Damages:

  1. Past and Future Economic Loss;
  2. Past and Future Domestic Care and Assistance;
  3. Past and Future Out of Pocket Expenses;
  4. Pain and Suffering.

This man attended upon the expert public liability lawyers of Gerard Malouf and Partners for a free consultation. During this consultation, our compensation lawyer discussed the claim generally with the client, on a no obligation basis. After taking a detailed history of the claim, the no win no fee structure was discussed and our client was happy for our firm to commence acting on his behalf.

Our compensation lawyer wasted no time in organising for him to be assessed for her injuries from an Independent Medical Examiner. These doctors comment on the permanent nature of the injuries, along with the future potential problems the injury will cause.

At the same time, the expert public liability lawyer began investigation as to the liability aspect of the claim. In order to be successful in a public liability claim it has to be proven that the person we are commencing legal action against was negligent in the injury occurring. Accordingly, items such as incident reports, witness statements and CCTV footage are requested to assist with these investigations.

Once all the evidence was received, documents were prepared by our accredited personal injury specialist to be filed in the District Court of NSW. Shortly after the documents were filed, our slip and fall claims specialist contacted the Defendant to see if there was an opportunity to have an Informal Settlement Conference, noting that our evidence was complete..

At the time of the Settlement Conference, our client was out of the country, but was available via telephone. Throughout negotiations, this client was kept abreast of how everything was proceeding, and instructions were taken prior to any offers being put forward. Ultimately, this particular client was delighted to accept a settlement offer of $150,000.00.

Most pleasing to this client was Gerard Malouf and Partners willingness to enter negotiations early, so as to limit the cost of professional fees incurred, along with their willingness to have him available via telephone despite not being in the country.
