Injured Worker Receives Over $350,000 in Compensation for Workplace Dermatitis

Our client worked at a hospital for over 30 years as a kitchenhand. Her employment at the hospital required constant exposure and contact to cleaning chemicals and detergents during the course of work.
This lead to our client developing chronic dermatitis in both her hands. She often experienced very painful symptoms where the skin on her hands would crack and bleed leaving her in excruciating pain which forced her to take days, and even months off work. She also developed dermatitis in her feet and legs.
She was subsequently certified totally unfit to work in her pre-injury occupation by her treating doctors.
We successfully settled a permanent impairment claim for 17% Whole Person Impairment with the Workers Compensation Insurer. Because our client’s Whole Person Impairment was agreed at over 15% WPI, she becomes eligible to potentially bring an additional claim for Common Law Modified Damages, also known as Work Injury Damages which is a claim in negligence.
We then advised our client of a potential claim in negligence against her employer for their failure to provide a safe system of work which caused her contact dermatitis condition.

Our client ultimately received over $350,000 in compensation from the workers compensation insurer.
