Irish Man awarded Compensation after sustaining injury in a Motor Vehicle Accident
Published 25 Jul 2017
Mr E, an Irish national, was driving his motor vehicle along a busy road in Port Macquarie. Our client’s vehicle came to a standstill as he waited for the vehicle in front of him to turn right, when suddenly, another vehicle collided into the rear of Mr E’s vehicle, causing him to sustain serious injuries to his back, neck, right shoulder, and serious psychological injuries.
Over the next few days Mr E noticed increasing pain in his back and neck. He consulted his family Doctor who recommended that Mr E have various radiological investigations. These investigations revealed that Mr E had suffered some significant injuries to neck, back and right shoulder which required referral to a Specialist.
Mr E was not an Australian Citizen and held a working Visa. Therefore he was not sure if he was entitled to bring a claim for personal injury as a result of the motor vehicle accident.
Mr E contacted Gerard Malouf and Partner Personal Injury Lawyers to enquire as to whether or not he was entitled to make a claim. Upon speaking to one of our Personal Injury Lawyers, Mr E was advised that he did have a valuable claim that should be vigorously pursued.
A conference was arranged for Mr E at our Port Macquarie office and instructions were taken from him.
With the assistance from one of our Compensation Lawyers, Mr E lodged a Personal Injury Claim Form and the relevant CTP insurer admitted liability, providing that the other driver was at fault and caused the accident.
When Mr E’s injuries stabilised medico-legal assessments were organised and we obtained medical evidence from his treating Doctors, as well as an Orthopaedic Surgeon, a Psychiatrist, and Occupational Physician who assessed the extent of his injury and his need for future care and treatment.
Upon receipt of those Reports, arrangements were made with the insurer to discuss the matter at an informal settlement conference.
After extensive negotiations between the Claimant and the insurer, the matter resolved and Mr E was awarded a substantial amount in compensation, which he explained was an excellent outcome.
Prior to engaging our firm Mr E never imagined that he could achieve such an amount of compensation. The amount achieved would assist him with covering the cost of future treatment and his loss of income whilst he looked for alternative employment.
