Injured Car Passenger Receives $425,000 in Compensation

Mrs X was a passenger in a car being driven by a friend of hers. Her friend lost control of the vehicle and caused it to fall into an embankment causing Mrs X to suffer numerous injuries including fractured shoulder, fractured sternum and fractured ribs.

As a result of the car accident Mrs X was transported to hospital to where she was treated.

Upon her discharge Mrs X contacted Gerard Malouf and Partners to ascertain whether or not she has any entitlements to make a claim.

Action Taken:

At Gerard Malouf and Partners a personal injury claim form was lodged on behalf of Mrs X and the claim number was allocated by the third party insurer who ultimately accepted liability for the accident.

When Mrs X injuries had stabilised we arranged for her to be assessed by various doctors including an orthopaedic surgeon, psychiatrist, occupational physician and an occupational therapist. All of this doctors commented on Mrs X injuries and need for treatment, her capacity to work and her need for domestic care and assistance.

The insurer refused to accept Mrs X injuries were greater than 10% therefore a dispute arose which was referred to the Medical Assessment Service to determine. The Medical Assessment Service appointed doctors who assessed Mrs X and those doctors found that her injuries were greater than 10% whole person impairment.

Following receipt of those reports an appointment was arranged to discuss the matter at an informal settlement conference and after substantial negotiations the matter resolved.

Conclusion:

Mrs X was thrilled with the outcome and she was not expecting to receive that much compensation however she was thankful and grateful that the firm was able to put that amount of money in her pocket noting that she continued to have restrictions at work and was unable to return to her pre-accident hours.
