Pedestrian Receives $278,000 in Compensation after being struck on pedestrian crossing

Mr C was attempting to cross the road at Marrickville NSW when he was struck by a vehicle which failed to give way to him. As a result he was knocked to the ground and sustained a fracture of his right leg, knee and foot. 

As a result of the accident Mr C was transported to hospital to where he was treated.

Upon his discharge Mr  C contacted Gerard Malouf and Partners to ascertain whether or not he has any entitlements to make a claim.

Action Taken:

At Gerard Malouf and Partners a personal injury claim form was lodged on behalf of Mr C and the claim number was allocated by the third party insurer who ultimately accepted liability for the accident.

When Mr  C’s injuries had stabilised we arranged for her to be assessed by various doctors including an orthopaedic surgeon, psychiatrist, occupational physician and an occupational therapist. All of these doctors commented on Mr C’s injuries and need for treatment, his capacity to work and his need for domestic care and assistance.

The insurer refused to accept that  Mr C’s injuries were greater than 10% therefore a dispute arose which was referred to the Medical Assessment Service to determine. The Medical Assessment Service appointed doctors who assessed Mr C and those doctors found that his injuries were less than 10% whole person impairment.

Following receipt of those reports an appointment was arranged to discuss the matter at an informal settlement conference and after substantial negotiations the matter  resolved.


Mr C was thrilled with the outcome and he was not expecting to receive that much compensation however he was thankful and grateful that the firm was able to put that amount of money in his pocket noting that he continued to have restrictions at work and was unable to return to her pre-accident hours and duties.
