$500,000 awarded to Western Sydney woman who broke her leg after tripping on concrete footpath at residential premises

We recently acted for a young Western Sydney woman who tripped over an uneven and poorly illuminated concrete pathway at a residential premises. As a result of this accident, she suffered significant injuries including fractures to her left tibia and fibula. These injuries affected her life considerably as she required a number of surgeries and subsequent lengthy recovery periods where she was unable to work or carry out domestic duties. In addition to the physical impacts, our client also developed post-traumatic stress disorder and major depressive disorder as a result of the accident.

Ultimately, expert evidence revealed that the failure to ensure that the concrete path was well-lit and level was supportive of the fact that the defendant breached their duty of care to our client – and as a result were negligent and responsible for her injuries.
After collection of all expert evidence, the parties agreed to participate in an informal settlement conference. After vigorous negotiations, Ms Nelsen was ultimately able to secure a figure of $500,000 for our client.
