Sydney woman settles claim for nerve damage caused by poor operative positon for $150,000

A young lady from central Sydney attended her gynaecologist following the development of severe abdominal pain. She was taken by ambulance to a major Sydney hospital where her gynaecologist conducted an emergency laparoscopic exploration.

During this procedure she was placed in a lithomy position (a supine position of the body with the legs separated, flexed, and supported in raised stirrups, originally used for lithotomy and later also for childbirth).

Following the procedure she began to notice periods of shooting pain down her left leg. This was pain that had not existed previously. For some time she continued to live her life with this pain however the severity increased over time and the impact it had began to leak into aspects of her social, domestic, professional and academic life.

For this reason she approached Gerard Malouf and Partners. She had always suspected that this injury was occasioned during her operation however it was not until Mr Leslie Abboud, Senior Solicitor with over 30 years of experience took carriage of her matter that it was established that her leg positioning and use of stirrups had actually injured her sciatic nerve.

Upon receiving the matter, Mr Abboud and his team quickly sought the opinion of highly regarded doctors and experts where it was shown that the hospital and doctor were likely negligent in failing to properly position her leg and ensure it was not under undue pressure for an extended period of time.  Mr Abboud provided the evidence to the Defendant solicitors and arranged for mediation to take place.

Mr Abboud and his specialist medical negligence team, as well as an expert barrister, pursued the matter progressively and sought to negotiate with the defendant at mediation. It eventually settled for around $150,000.00, much to the client’s satisfaction.
