Lump sum compensation for post traumatic stress disorder caused by death in workplace

Our client was involved in a fatal workplace incident which resulted in a death at work. As a result of this incident, our client developed severe post-traumatic stress disorder and other psychological conditions. He has been unable to work since his injury and has been in receipt of workers compensation benefits.

Given that this incident resulted in a death at the workplace, WorkCover NSW commenced an intensive investigation of the employers work health and safety systems within the workplace.

The employer has since been found to breach several requirements in respect of Work Health and Safety requirements, and have been fined serval hundreds of thousands of dollars for their breaches.

Our client consulted the expert solicitors of Gerard Malouf and Partners seeking advice for a potential claim against his employer. The claim was then initiated for permanent impairment lump sum compensation for our client’s psychiatric condition.

He was able to successfully achieve a permanent impairment rating of 22% Whole Person Impairment. He was awarded over $35,000.00 for this claim.
