Disability support worker receives $90,000 in compensation for work injury

It is so often that disability support workers sustain injuries during the course of their employment.  Just like nurses, caring for those that are unwell, sick and disabled has an element of risk involving for these carers. Their work is demanding in nature.

Disability care workers with injuries end up needing support themselves. It is most unfortunate that these carers in our society are left with long term injuries and incapacity, rather than being rewarded for their years of service for the needy of our community. They are left fending for themselves to sustain financial viability and a quality life.

Our office lawyers were contacted by this particular lovable and caring disability worker needing assistance for a compensation claim.  She was hesitant about the whole process as she did not want to upset her employer and nor did she want to upset the worker’s compensation insurer.  The workers compensation insurer had accepted liability and had paid her for the time she had off work as a result of the injury and also paid for various medical treatment.

At Gerard Malouf & Partners we counsel our clients and provide them with proper and appropriate advice of their entitlements.  We leave it to our clients to make a decision if they wish to make a claim for compensation.  In this instance, we reassured our client that her employment would not be jeopardised if this matter proceeded and if she was to receive a lump sum payment.

As it turned out, we were not only able to pursue a claim for lump sum benefits for her through her statutory entitlements, we were also able to claim damages in a work injury damages claim.  The overall amount of tax free compensation she received was slightly over $90,000.00. This particular worker had received monetary compensation clear to herself at a level of which she was never expecting.

Sometimes those who support others do need support themselves.  We realise that at Gerard Malouf & Partners. We supported this lovely person by giving her encouragement and providing sound legal advice.
