Elderly Sydney Eastern Suburbs Man Injured on Public Bus is Awarded $65,000

Our client was an elderly man from the Eastern Suburbs who was travelling on a public bus, and was injured when the bus came to a sudden stop. As a result, our client suffered injuries to his left leg and to his right wrist.
Our client’s injuries had a major impact on his life. The injuries caused our client ongoing pain and restricted his ability to perform the tasks he had previously performed. Our client lived alone with his disabled wife and he was responsible for most domestic tasks and gardening work which he could no longer perform after the accident. Our client became dependant on his children to help him manage his household. However this was not a long term arrangement as his children all lived at a distance.
Upon attempting to make a claim himself, our client promptly identified the difficulties he would face and in particular the road blocks the insurer would put forward so as to limit the compensation payable to him. He decided to contact the compensation team at Gerard Malouf and Partners to help him navigate through the complicated legal field to appropriate compensation.
Upon meeting with the client David Cossalter, senior compensation lawyer, arranged for our client to be assessed by an orthopaedic surgeon. Upon receipt of adequate medical evidence, David, in an attempt to ensure a quick and cheap resolution of the matter, arranged a conference with the defendant solicitors.
At this conference the defendant was not willing to make any reasonable offers. To show the insurance company that we took our client’s claim seriously David then filed proceedings in the District Court of NSW which prompted the defendant to seek a further settlement opportunity.
At the next settlement conference the defendant insurers came to the table and made our client an offer of $65,000.00 in compensation. Our client was happy to accept this offer as he felt it was proper acknowledgement of the ongoing effects of his injuries. The money helped our client to alleviate the stress which resulted from his injuries.
